1. What Sell My Home Market is

Sell My Home Market™ ("we," "us") operates an online marketplace that connects homeowners who want to sell with licensed real estate agents who compete to represent them. We are not a real estate brokerage, we do not represent buyers or sellers in a transaction, and we do not provide legal, tax, or financial advice.

All real estate services are performed by the independent licensed agent and brokerage a seller selects. Any listing agreement is between the seller and that agent's brokerage, not with us.

2. Using the marketplace as a seller

Sellers use the marketplace at no cost. By submitting a property you confirm that you are the owner of record, or that you are legally authorized to sell the property on the owner's behalf.

• You are never obligated to accept any proposal or select any agent.
• You may request additional proposals or withdraw your listing at any time before selecting an agent.
• Your name, phone number, and email address are not shared with competing agents. They are released only to the single agent you select.
• Property valuations shown on this site are automated estimates based on third-party data. They are not appraisals and should not be relied on as a statement of market value.

3. Using the marketplace as an agent

Agents must hold an active real estate license in good standing in the state where they compete. By joining you confirm that you do, and that you are permitted by your broker to accept referral opportunities.

• There is no subscription, per-lead charge, or upfront cost to compete.
• On each proposal you choose the referral amount you will pay if you win the listing and the sale closes. That amount is your decision.
• The referral is earned and payable at closing. If the transaction does not close, no referral is owed.
• The formal referral agreement is executed by your designated broker after you and the seller have signed a listing agreement.
• Proposals must be accurate. Misrepresenting your license status, track record, brokerage, or terms is grounds for removal from the marketplace.

4. How proposals are ranked

When bidding closes we score each proposal using a combination of the economics offered to the seller, the referral offered to us, the agent's stated track record, program fit, local service area, and responsiveness. Sellers may also mark agents as preferred, and those preferences take priority over the score.

Scoring criteria and weightings may change as the marketplace evolves. Ranking is not a recommendation, endorsement, or warranty of any agent's performance.

5. Accuracy of information

Property records, ownership data, and valuation estimates come from third-party providers and public records. This information can be incomplete or out of date. We do not warrant its accuracy and it should be independently verified before any transaction.

Agent-supplied information, including sales history and performance statistics, is provided by the agent. We may verify it but do not guarantee it.

6. Communications

By creating an account you agree to receive transactional emails and text messages related to your listing or agent activity. Message and data rates may apply. You can opt out of text messages by replying STOP, and out of marketing email using the unsubscribe link. Certain transactional messages are necessary to use the service.

7. Accounts

You are responsible for activity that occurs under your account and for keeping your contact information current. We may suspend or terminate any account that violates these terms or that we reasonably believe is being used fraudulently.

8. Disclaimer and limitation of liability

The service is provided "as is." To the fullest extent permitted by law, we disclaim all warranties, express or implied. We are not liable for the acts or omissions of any agent, brokerage, or seller, or for the outcome of any real estate transaction arranged through the marketplace.

9. Fair housing

We support the Fair Housing Act and equal opportunity in housing. Sellers and agents may not use the marketplace to discriminate on the basis of race, color, religion, sex, familial status, national origin, disability, or any other protected class.

10. Changes

We may update these terms. Material changes will be reflected in the "last updated" date above, and continued use of the service after a change constitutes acceptance.
